How does one make an economic decision when the price of a good is not evident? To any adherent of the Austrian school, this of course is impossible. There is no way to decide whether to purchase something if the only way of knowing the price is after committing. For example, who would fill up their car only to see what the price was at the end? No one. In no aspect of life would this make sense, yet it is the standard in the American healthcare system.

In June 2021, the Mises Institute held the Medical Freedom Summit in Salem, New Hampshire, and one of the speakers was Dr. G. Keith Smith of the Surgery Center of Oklahoma, an institution that is truly free market and receives no money from the federal government. He spoke of the successes of his business and of the simple model he and Dr. Steve Lantier established in 1997. Smith describes their first patient experience as follows:

He later told the story of a Georgia man who was quoted $40,000 for his surgery at home. The Surgery Center of Oklahoma quoted him $4,000. Upset at having lost a patient to them already, the man’s hometown surgeon decided to match the price. The patient told Dr. Smith that the Surgery Center of Oklahoma “had saved him $36,000 and … hadn’t even performed his surgery.”

Once again we learn that the Gooferment has really really messed up “health”, “health care”, “health care insurance”, or something else like our lives.

Just separate “health insurance” from employment by making health insurance premiums deductible from the top line, just as it is for businesses, and level the playing field.

After all you don’t lose your car insurance when you change jobs.  Why should health insurance be any different?

Writer Alex Berenson has taken notice of this too and did some quick research. He found a blog that says there is no order, confirming exactly what the congressman told me. 

If there is no [private sector] mandate yet, then obviously, none of the companies are under any obligation to enforce it.

OSHA is apparently the federal agency responsible for framing a set of regulations for the mandate, including fines. But federal agencies only construct regulations after a law has been passed or an EO is issued.

If I’m correct, and no EO has been published, we have an odd situation, to say the least.

Governors and lawyers have been threatening to sue, because the EO is unconstitutional and overrides state powers. But if there is no Presidential EO, then all these legal cases would be meaningless, because, again, there is no official mandate.

Is the White House stalling? Do they realize the EO and the mandate will be overturned in court? Are they hoping to achieve corporate compliance without an official mandate?

I’ve queried several lawyers. One suggested that so far, in this situation, the feds are mandating by bluffing.

“We, The Sheeple” should reject corporate mandates that allude to “regulations” because there are none.

Woo-hoo! It is a wonderful thing when the good guys win one for a change. Well, it wasn’t a total win, but it gives hope.

In a case brought by the Wisconsin state government — with full cooperation from the federal government — a jury refused to convict Amish farmer Vernon Hershberger on all counts for distributing milk, cheese, and meat without a license. He did he end up with one conviction, for which he faces a year in jail, but that’s nothing compared with what might have happened.

Now, there are still many people who would read the above and say: Wait just a minute here. You mean to tell me that a farmer was hounded by bureaucrats for selling his own food to others who wanted to buy it?

Indeed. His farm was raided in 2010, and much of his milk and cheese was destroyed by the police. The conviction was based on Vernon’s desire to fulfill his commitments and distribute what remained.
