However, on Wednesday, the 11th Circuit Court of Appeals brought back the lawsuit and granted BHJ’s attorney the ability to sue the Madison County school board.

“This is a unique case because the administrators effectively participated in (the boy’s) sexual harassment by setting (Jane) Doe up in a rape-bait scheme involving (the boy) in order to ‘catch him in the act,’” found the appeals court.

The lawsuit will now continue and with any luck, BHJ will receive just compensation for her role as a pawn in the school’s ridiculous plan.

The Social Security/Medicare Trustees have issued their latest reports and they are not easy reading for the uninitiated. I suspect most of the Trustees hope you don’t read them at all. They prefer their own spin. Under both Republican and Democratic administrations, these reports are invariably accompanied by a press release that completely ignores what is important and focuses instead on what is unimportant.

What’s unimportant? The trust funds and when they will run dry. Like most social security systems in the world today, ours is a pay-as-you-go system. Nothing has been saved or invested. What we call trust funds consist of nothing more than IOUs the government has written to itself. (More on that below.) Yet, that is what the official press releases emphasize and this focus is reflected in the first graph below.

What’s important? Cash flow. In fact, in a pay-as-you-go system, cash flow is the only thing that matters. As the second graph shows, Social Security and Medicare are paying out more than they are taking in. As the baby boomers retire, the total deficit will grow dramatically. Currently, we are using about one in every seven general revenue dollars to cover these deficits. By 2020, we will need more than one in five. By 2030, we will need about one in three.

Like most Ponzi schemes, eventually the suckers’ money runs out.

And, all the politicians and bureaucrats from FDR are going to be long gone.

So what should be done about this and ALL the unfunded liabilities?

At the very least, everyone should REALIZE that the current system is unsustainable.

Even a fat old white guy injineer or a reasonably competent accountant can demonstrate that there ain’t no free lunch.

  • Old advice: “when in a hole, stop digging” seems to apply here.
  • Hard stop on all new “pensions”. Require all such to be fully funded!
  • All plans must “mark to market” with honest accounting.
  • “Chile” style social security reform
  • Congress must live within what the taxpayers can afford
  • Any deficit is paid for my Congress folks personally
That’s should get everyone’s attention?

Unfortunately, I didn’t pay attention when my grandfather would fix what ever particular “$50″ wreck I was driving that week.

In the past, my strategy was to buy new on a three year loan and keep “paying” myself until it died. Eventually, I could pay cash for cars. Seemed to work for me.

Last car, with “zero down and zero interest”, my financial advisor convinced me to take the free money and leave the cash in my portfolio. I’ll drive it until the wheels fall off which means it should last about 9 years.

What I’ll do then I have no idea. What the economic climate will be I have no idea. But I’ll adapt since it’s obvious that the “only constant is change”.

For anyone who’s got some mechanical ability, old cars / trucks that you can still work on seems to be a profitabe niche.

When I drive to and from the Jersey shore, I see veritable series of “one car used car lot” (i.e., each house  along the way with one, or maybe two, used cars for sale). As the season progresses, more “projects” roll out for sale. The peak is around “back to school season” when the sports cars seem to dominate the “lots”.

The USA has become the throw away consumer economy at its own peril. Perhaps this is the renaissance?

I think this is more a reflection on the value of Federal Reserve Notes and the bad behavior that it has “trained” the shepple to engage in.

Personally, I am amazed at the attitude towards women.

These are not “delicate flowers” that will be ruined by a mere touch.

These are living breathing powerful people capable of “creating” life.

If I had a child, I wouldn’t let any religious notion prevent me from keeping my child alive. Even at risk or certainty of my dying.

From an economic pov, it’s really good that ⅔ of the world keep women and minorities “in their place”. Imagine how much wealth could be created if they were free to create in a truly free capitalist system.

A lot of leaders in the tax protest movement have done jail time for their consistency. They did what they told others to do. They are now convicted felons with no money.

Some are still in jail. Irwin Schiff is one of them. He may get out in two years. He has been in jail since 2006. Are you ready to imitate him? Read this first.

Trusting laymen in the tax revolt movement are often unaware of just how consistently the IRS has gained convictions.

There are always exceptions, but the pattern is clear: juries normally convict. These protesters use arcane language and references to tax law cases that do not apply. It does them no good. These people jabber in jailhouse lawyer babble, and then they wind up in jail. They really do become jailhouse lawyers.

I prefer to not engage in Phyrric Victories, Don Quixote quests, or fights that I can’t win.

Income taxes are like that category.

As a little L libertarian, I think that the Gooferment is immoral, ineffective, and inefficient. Taxes are theft.

BUT, (and there is always a BIG butt), until juries refuse to enforce the Income Tax diktats, I’ll kowtow.

Like the “(pseudo) War on (some) Drugs”, tyranny will end when the Sheeple and Clovers no longer convict.

That why I never get on juries. I want to see a victim. The Gooferment, its politicians and bureaucrats, are NOT victims. They are the aggressors.

Found another useful reason to use Google Voice instead of your cell phone number.

(Remember, the last tip was for young ladies to give men their GV# so that they can automagically delete them if they turn out to be a loser.)

This tip is as a result of my Gal Pal’s blackberry going crazy. It’s essentially useless and she has no way to let folks know it. So she’s using my phone to alert folks.

IF she had used a Google Voice number and tied that to her cell phone, she could respond on the GV website and even send out an alert that she had a harder problem.

Interesting.

I think it’s very useful.

The truth be known, I really don’t give a damn about soccer. Nor do most Americans.

Second, and much more important, it’s really none of our business. Despite the fact that the FBI has taken it upon itself to prosecute at least 14 FIFA officials for corruption.

Why is it none of our business? Because FIFA is a Swiss association that’s been around over 100 years. All of its officers and directors are non-US persons. And about 99% of its players, officials, and spectators are non-American.

But that doesn’t matter. The FBI has decided to prosecute FIFA’s officials for corruption, and is successfully moving to have them all extradited to the US for trial.

Were FIFA officials treating themselves to huge salaries and expense accounts, and paying and receiving millions to decide where the World Cup should be played? Of course. Is that corrupt? We have to first define “corruption.” I devote a lot of thought to the subject here, and suspect you’ll find it of interest. But, essentially, corruption is about a betrayal of a fiduciary trust. In simple terms, it’s sticking your hand in a till that you’re supposed to guard for the interest of someone else.

A very fundamental observation about “jurisdiction”.

The Gooferment has to rush ahead of the “headlines” to get in front so it pretends to be leading.

What has the FBI done about Planned Parenthood and the baby parts scandal?

Nothing because that is “politically inconvenient”.

It’s a great principle.

Maybe not up there with the Non-Aggression principle, the Law of Gravity, or even the Law of Supply and Demand, but up there on my list.

Only “capitalism” lifts the poor to a higher standard of living without conflict. (Even Bono recognized “enterprise” was better than “foreign aid”.)

Transportation Secretary Anthony Foxx said Friday the government has opened a price-gouging investigation involving five airlines that allegedly raised airfares in the Northeast after a deadly Amtrak crash in Philadelphia in May disrupted rail service.

The Transportation Department released letters to five airlines — Delta, American, United, Southwest and JetBlue — seeking information on Friday.

“The idea that any business would seek to take advantage of stranded rail passengers in the wake of such a tragic event is unacceptable,” Foxx said.

DOT is exploring whether the price hikes violated federal regulations prohibiting airlines from engaging in unfair and deceptive practices and asked the airlines provide information of pricing and seat availability for a time period before and after the crash.

The Gooferment’s “price-gouging” is the free market allocating scarce resources to those who need it the most.

If the price is artificially low versus the demand, then there are shortages, queues, and rationing.

If the price is unacceptably high, then the consumer will seek alternatives — driving for one thing, the bus for another, or delay / change / cancel your trip. Perhaps even carpool. 

The free market will allocate based on price to the “neediest”.

That’s the “fairest” way to handle any allocation of a scarce resource; not with a Gooferment investigation.

And, doesn’t Amtrak belong to the Gooferment!

Argh!

Perhaps they are trying to distract us from their immoral, ineffective, and inefficient “running of a railroad” to the evil private airlines.

So if investment is the problem, what does Hillary Clinton go out and do? She proposes jacking up the tax on investment. It’s almost inconceivably stupid. 

In her latest economic speech, Clinton proposes doubling the capital-gains tax rate on the profit made from asset sales (stocks, bonds, real estate) held a day less than one year up to two years. Right now, if you take a capital gain a day more than one year, you are taxed at a 20 percent rate. Actually, it’s 23.8 percent when you include the healthcare surtax. So under Clinton’s brilliant new play, you’d be taxed at 43.4 percent — the top individual cap-gains rate of 39.6 percent plus the 3.8 percent Obamacare surtax.

That means, instead of keeping 80 cents on the additional dollar of profit, you’d only keep 56.6 cents — a 30-percentage-point reduction in the take-home-pay reward for taking an extra dollar’s investment risk.
This will create a tall barrier to investment — what we don’t need. If you tax something more, you get less of it.

I rant a lot about the corporate income tax. Only real people pay taxes. Corporations are merely fictions that hide the Gooferment’s taxes from sight. 

When you try to figure out how much tax you really pay, look at a can on beans and try to guess what percentage of the price is really hidden taxes. Don’t forget all the incremental taxes along the way from the bean field to the store. Argh!

And, who owns all the capital invested in stocks and bonds — pension funds.

So, the political class is robbing the taxpayers blind.

One factual detail, routinely emphasized by his supporters, is his repeated claim that except for signing a single written statement very early in his captivity and also answering some questions by a visiting French newsman, he had staunchly refused any hint of collaboration with his captors, despite torture, solitary confinement, endless threats and beatings, and offers of rewards. Perhaps. But that original Counterpuncharticle provided the link to the purported text of one of McCain’s pro-Hanoi propaganda broadcasts as summarized in a 1969 UPI wire service story, and I have confirmed its authenticity by locating the resulting article that ran in Stars & Stripes at the same time. So if crucial portions of McCain’s account of his imprisonment are seemingly revealed to be self-serving fiction, how much of the rest can we believe? If his pro-Communist propaganda broadcasts were so notable that they even reached the news pages of one of America’s leading military publications, it seems quite plausible that they were as numerous, substantial, and frequent as his critics allege

When I later discussed these troubling matters with an eminent political scientist who has something of a military background, he emphasized that McCain’s history can only be understood in the context of his father, a top-ranking admiral who then served as commander of all American forces in the Pacific Theater, including our troops in Vietnam. Indeed, the alleged headline of the UPI wire story had been “PW [Prisoner of War] Songbird Is Pilot Son of Admiral,” highlighting that connection. Obviously, for reasons both of family loyalty and personal standing it would have been imperative for John McCain’s father and namesake to hush up the terrible scandal of having had his son serve as a leading collaborator and Communist propagandist during the war and his exalted rank gave him the power to do so. Furthermore, just a few years earlier the elder McCain had himself performed an extremely valuable service for America’s political elites, organizing the official board of inquiry that whitewashed the potentially devastating “Liberty Incident,” with its hundreds of dead and wounded American servicemen, so he certainly had some powerful political chits he could call in.

Placed in this context, John McCain’s tales of torture make perfect sense. If he had indeed spent almost the entire war eagerly broadcasting Communist propaganda in exchange for favored treatment, there would have been stories about this circulating in private, and fears that these tales might eventually reach the newspaper headlines, perhaps backed by the hard evidence of audio and video tapes. An effective strategy for preempting this danger would be to concoct lurid tales of personal suffering and then promote them in the media, quickly establishing McCain as the highest profile victim of torture among America’s returned POWs, an effort rendered credible by the fact that many American POWs had indeed suffered torture.
