A Gun-Control Measure Conservatives Should Consider

Gun-violence restraining orders (GVROs) make us all safer while empowering the individual and protecting liberty.To understand the American gun-control debate, you have to understand the fundamentally different starting positions of the two sides. Among conservatives, there is the broad belief that the right to own a weapon for self-defense is every bit as inherent and unalienable as the right to speak freely or practice your religion. It’s a co-equal liberty in the Bill of Rights, grounded not just in the minds of the Founders but in natural law.

Against this backdrop, most forms of gun control proposed after each mass killing represent a collective punishment. The rights of the law-abiding are restricted with no real evidence that these alleged “common sense” reforms will prevent future tragedies in any meaningful way.

While there are various versions of these laws working their way through the states (California passed a GVRO statute in 2014, and it went into effect in 2016), broadly speaking they permit a spouse, parent, sibling, or person living with a troubled individual to petition a court for an order enabling law enforcement to temporarily take that individual’s guns right away. A well-crafted GVRO should contain the following elements (“petitioners” are those who seek the order, “the respondent” is its subject):

  • It should limit those who have standing to seek the order to a narrowly defined class of people (close relatives, those living with the respondent);
  • It should require petitioners to come forward with clear, convincing, admissible evidence that the respondent is a significant danger to himself or others;
  • It should grant the respondent an opportunity to contest the claims against him;
  • In the event of an emergency, ex parte order (an order granted before the respondent can contest the claims), a full hearing should be scheduled quickly — preferably within 72 hours; and
  • The order should lapse after a defined period of time unless petitioners can come forward with clear and convincing evidence that it should remain in place.

While I would open up the “narrowly defined class of people” to include neighbors and others with direct knowledge and / or concern.

A road rage victim, someone threatened on social media, someone who sees “something” on social media should all be permitted.

If they are willing to use their own time, money, and resources to make a case before a Judge, then they should be heard. 

Frivolous actions should be sanctioned for those who misuse the process; like the SLAP stuff for those who file frivolous lawsuits.

The judge should be able to be able to set the time period for the sanction to apply.

The  judgment should be quickly registered to prevent acquisition, a warrant issue, to search for the defendant’s weapons in “all the usual places”, and seize any found. To be returned when the order lapses.

Seems like a good idea to me.

It’s an adversarial process where defendant has rights.

A South Florida high school became the latest scene of a deadly mass shooting in the U.S. after a gunman opened fire at the end of the school day, leaving 17 people dead and more than a dozen injured. The suspect, who is in custody, is 19-year-old Nikolas Cruz, a former student who had been expelled for disciplinary reasons, police said. Broward County Sheriff Scott Israel said the suspect had “countless” gun magazines and one “AR-type rifle.” The victims include both students and teachers, the sheriff said. Twelve people were killed inside Marjory Stoneman Douglas High School in Parkland, Fla., and three outside the school. Two others died at the hospital. The Florida school shooting is the deadliest since the 2012 shooting at Sandy Hook Elementary School in Newtown, Conn., where 20 children and six adults were killed. It is the third-deadliest school shooting in modern U.S. history, after Sandy Hook and Virginia Tech. One parent, who reached his daughter on the phone as the shooting unfolded, said: “She’s 14 years old and she had to see multiple dead bodies….It’s something that you hear about all the time, and you never think it will happen to you.”

Now that a little time has past, here’s my “solutions”.

  • “Gun-free zones” are nothing more than “Target rich environments”. End them!
  • Arm any teacher, bureaucrat, or custodial person interested.
  • Screen the students for “wackos”.
  • Study the relationship between these events and the drugs given to young men.
  • Surveil “social media” sites for young men with weapons fetishes.
  • “Harden” the Gooferment Skrules.
  • Implement “Constitutional Carry” like in Vermont.
  • Pass “National Reciprocity”; just like “drivers’ licenses”.
  • Enforce the existing laws & enforce prison terms like “felon in possession”, “straw purchases”, and “attempted purchases by disqualified persons” with NO plea deals! (DJT45 should be leaning on the various Deputy Attorneys around the country for regular reports on their results.)

You can screen for wackos like your blog says, but then what do you do?  You can’t arrest or detain them….and that certainly would go against your libertarian civil liberties.  I’m not sure there is a defense for this stuff…at least on that vein.

[JR: You most certainly can “detain” them as “threat to themselves and others”. All States have a 72 hour hold. And, an adversarial court finding would bar them from purchasing firearms under the current laws.]

In the wake of the heinous attack on Florida’s Marjory Stoneman Douglas High School, pro-gun control liberals spread the misleading claim that there have already been 18 school shootings in 2018.

For example, in Everytown for Gun Safety’s breakdown of the alleged shootings, it is evident that eight of the 18 incidents did not result in any injuries or fatalities. Of the remaining 10 alleged shootings, Everytown lists two as an “attempted or completed suicide, with no intent to injure other person.” One of the suicides occurred in the bathroom of an Arizona school and the second in the parking lot of a Michigan school. No one else was injured in either incident.

Of the remaining eight incidents, Everytown lists one as a “gun fired unintentionally.” Of the remaining seven, where a gun was fired to harm others, at least one of the incidents was a single shot fired following an early morning fight at Wake Forest University. One shooting happened outside a Louisiana high school resulting in a 14-year-old receiving an “superficial” wound, and another resulted in a 15-year-old girl being wounded by a 16-year-old boy.

When suicides, accidental discharges, purposeful shootings without injuries, and purposeful shootings with only “superficial” wounds are counted as school shootings on par with the attack on Marjory Stoneman Douglas High School or Columbine, then we have reached a point when the phrase “school shootings” can connote anything.

A History of Violence 

The gunman who killed 26 people at a Texas church on Sunday morning had a history of domestic abuse, animal abuse and trouble holding down a job, as well as a failed marriage. But 26-year-old Devin Patrick Kelley’s violent past didn’t prevent him from purchasing weapons. One reason is that the U.S. military failed to submit Kelley’s record to the FBI after a court-martial conviction, including for slamming his baby’s head. The military’s lapse apparently explains why Kelley passed an FBI background check and was allowed to purchase guns in recent years. Authorities are still piecing together his motive. Leading up to the shooting, Kelley sent threatening text messages to his mother-in-law. The shooting left a community in Texas with unspeakable losses: The youngest victim was 1½ years old; the oldest, 77.

It’s where a large number of conservative and libertarian gun owners–including myself, to be clear–volunteered to help teach the LGBTQ community how to shoot so they could protect themselves.

In short, the average gun owner isn’t interested doing a thing to anyone in the Trigger Warnings group…except maybe chuckle at their name because it’s kind of awesome.

Don’t get me wrong, the concerns about neo-Nazis have a place. They’re out there and they’re a threat to pretty much anyone who disagrees with them on anything, but more so for people who are part of groups lacking approval by their warped ideology. Being concerned about those threats definitely has a place in one’s training.

All the gun owners that I’ve met — not a statistical study by any means — are just folks who want to have fun, shoot strange stuff, and not be bothered by busybodies.

I recently read that gun shootings by non-police have an extremely small percentage of error or harm to innocents. Further, that just the presence of a good person with a gun tends to stop crime. Finally, “gun free zones” are dangerous because they attract the bad guys.

What they favor is “Victim Disarmament.”

She had pepper spray with her when she was attacked on Florida State University’s campus in 2014, the victim testified. But the spray did not stop the attacker.

Citing 4Jax, Breitbart News reported on Aug. 6 that college campus rape survivor Shayna Lopez-Rivas testified: “He had a knife. I had pepper spray. And even though I ran for blue lights that are scattered all around, (he was) faster, stronger, and I did not win.”

She said she now carries a gun and the next attacker will not find her to be easy prey. Ms. Lopez-Rivas testified that if she had had her gun with her in 2014 she could have stopped that attacker in his tracks.

She said “The way that I carry it now, I would have been able to prevent what happened to me.”

Lopez-Rivas was asking Florida legislators to pass campus carry so women with concealed carry permits can carry their guns on campus for self-defense.

I search in vain in the work product of Leah Libresco and her outfit for a single word about the BENEFITS of private firearms ownership. And we haven’t even gotten to Maryann Watkins’ account of what the would-be rapist with the coil of rope around his arm said after he approached her in the deserted Arizona highway rest stop, declaring “I’m gonna have some REEEEEEAL fun now!!”

Producing her Ruger from her fanny-pack and centering its sights on his chest, she responded: “If you want to play, we’ll play with this.”

“Bitches with guns,” he complained, over and over again, as she backed to her car and drove away. “Bitches with guns.”

The Johnsons were going to take custody of their grandson to keep him from going into foster care. When they went to pick up their grandson, William, a retired, disabled Marine with a Concealed Pistol License (CPL), was searched for a firearm. He was not carrying a firearm at the time. At that point, agency officials told the Johnsons that they would be required to provide all firearms’ serial numbers to the agency as part of a registry. When Johnson questioned agency workers, he was given a surprising response.

“If you want to care for your grandson you will have to give up some of your constitutional rights,” a MDHHS worker retorted.

When the Johnsons appeared before a Gogebic County Court judge, the judge reiterated the agency worker’s statement.

“We know we are violating numerous constitutional rights here, but if you do not comply, we will remove the boy from your home,” the judge said.

  • Homeowner Patrick Hale is being called a hero for holding two fugitives in his driveway in Christiana, Tennessee 
  • Hale believes the suspects mistook his vehicle for a police car, he and his little girl were in his car 
  • Hale said though he had firepower with him, he never had to draw his weapon 
  • Donnie Rowe and Ricky Dubose surrendered to Hale, by laying face down in his driveway
  • Police arrived within three minutes of Hale calling 911 
  • The two convicts had been on the run since killing two guards on a prison bus on Tuesday 
  • On Thursday morning, police received a report that the two had held an elderly couple hostage and then stolen their Jeep
  • Police tracked down the Jeep and were trying to pull the convicts over when they crashed the car and bailed out
  • The two men ran into the woods and came across another house where they tried to steal another car 
  • They could face the death penalty when charged in officers’ deaths 
  • They made their first court appearance in Rutherford County, Tennessee Friday Both waived extradition to Georgia and will be returned to Putnam County within the next few days

One of the murdered guards was Christopher Monica (pictured), who had been a prison guard since 2009. He had been working an extra shift to pay for his ill wifeSgt. Christopher Monica and Sgt. Curtis Billue were overpowered and shot dead with their own weapons. The fugitives then locked up 31 other inmates and jumped out with the guards’ 9mm Glock pistols, carjacking a driver who happened to pull up behind them.

Strange behavior by the murderers. 

Clearly, an armed citizen, who was ready to use deadly force, put a stop to this.

Here’s an example of when I’d support the death penalty. Clearly these “mad dogs” are too dangerous to be allowed to live.

California Attorney General Xavier Becerra’s office this week filed new regulations for review over just what constitutes an “assault weapon” moving forward.

The state Department of Justice submitted draft regulations to the California Office of Administrative Law this week expanding the definition of an “assault weapon” in the state.

The state hasn’t released the proposed regulations to the public, submitting them “file and print only” even though California residents are facing an end of the year registration deadline to abide by the yet-to-be established rules.

This comes three months after the withdrawal of an initial proposed rule formulated during the administration of Attorney General Kamala Harris, now a U.S. senator, to address changes required by legislation passed last year. That rule had been submitted after a proposed emergency regulation on making now-outlawed pre-ban magazines capable of holding more than 10 cartridges compliant, which, in turn, has also been pulled.

The National Rifle Association and California Rifle & Pistol Association had fired off a prelitigation letter to the state, warning of several potential illegalities with the initially proposed regulations and now eagerly wants a look at the new regulations.

It’s just a version of the old “hidden ball” trick. Unfortunately for the politicians and bureaucrats of the Pepuls Republik of Kalifornia, the NRA and other “pro-Second Amendment” groups ain’t falling for it.

“We, The Sheeple” should INSIST that all regs, diktats, and “laws” be available for at least 90 days before a 30 day public comment period and THEN a 90 day “cooling off” period, before they get “voted” on.

That should give enough time to people to vote with their feet!

Concerned citizen holds Lowcountry burglary suspect at gunpoint external site

A Lowcounty burglary suspect was nabbed after authorities say a concerned citizen spotted him in a field and held him at gunpoint. The Orangeburg County Sheriff’s Office arrested 20-year-old Raekwon Maple of Cordova and charged him with second-degree burglary and possession of stolen goods. Deputies also charged 20-year-old Antonio Summers of Orangeburg who faces the same charges. Sheriff Leroy Ravenell said it all started around 1 p.m. when a concerned citizen reported two male subjects had fled from a Slaughter Drive residence after having watch them break in. “The caller said he had initially noticed the males after following a suspicious vehicle driving through the Creekmore subdivision off Columbia Road,” OCSO officials said.”The motorist called law enforcement after observing the males go into the residence.” According to authorities, while OCSO deputies were on their way, the burglars were seen fleeing the home when the home alarm system went off. K-9 units then tracked Summers who was then taken into custody. As he was being secured, another concerned citizen called authorities saying he had Maple held at gunpoint after spotting him hiding in a field. The sheriff’s office says one of the suspects had a high dollar watch reported stolen in another burglary that happened earlier this week. In that case, a Forest Drive home owner called her boyfriend after returning home and discovering a door had been broken. “As her boyfriend arrived home, the couple heard a noise inside the residence before a suspect fled out of the front door,” OCSO officials said. “The boyfriend, who has a concealed weapons permit, told law enforcement he fired two rounds at the fleeing suspects before they made good their escape,” authorities said.”That couple reported watches, jewelry, cash, and a substantial amount of change stolen.” Maple was out on bond for multiple charges prior to Friday’s break in, according to the sheriff’s office. The two men could be facing more charges as the ongoing investigation continues, Ravenell said. “This was perfect cooperation between law enforcement and the concerned community,” he said. “When the entire community is against you, you don’t stand a chance at criminal activity.”

On Monday, Barack Obama’s Social Security Administration (SSA) issued the final version of a rule that will doom tens of thousands of law-abiding (and vulnerable) disability insurance and Supplemental Security Income (SSI) recipients to a loss of Second Amendment rights under the guise of re-characterizing them as “mental defectives.” The SSA, for the first time in its history, will be coopted into the federal government’s gun control apparatus, effectively requiring Social Security applicants to weigh their need for benefits against their fundamental rights when applying for assistance based on mental health problems.

“You can’t win them all,” as the old saying goes, but when it comes to the Second Amendment, gun control advocates can’t even come close. Such is clearly the case with Miss Sloane, the latest of Hollywood’s repeated attempts to push a gun control narrative on the American people. Of course, they didn’t see this coming, any more than they saw a Donald Trump victory coming. But that’s because they refuse to acknowledge the basic simple truth about the American people when it comes to our firearms freedom. Well, we’ll say it again, the American people aren’t buying your anti-gun narrative.

Miss Sloane features Jessica Chastain as a Washington lobbyist who takes on “the establishment” to push for passage of gun control in the U.S. Congress. As reported by Stephen Gutowski at freebeacon.com, the “political thriller” opened last weekend to much buzz and fanfare among gun control groups, but tanked completely at the box office, making one industry list of the worst openings of the past 35 years for a movie with a national release.

Incredibly, Gutowski reports that a representative of the Brady Campaign to Prevent Gun Violence actually said, “… I can tell you that its production alone, with our input, is the success.” In other words, it is of little consequence that nobody wants to see a movie that pushes for gun control, its mere existence is what matters.

Anyone need more evidence that Hollywood is both “on a different planet” and out of touch with its Customers.

Gun control is a racist legacy of the KKK in the Deep South. Can’t terrorize minorities when they can shoot back.

Robert A. Heinlein said it best. “An armed society is a polite society. Manners are good when one may have to back up his acts with his life.”

Varmints of both the two legged and four legged varieties need to be put down quickly and efficiently. Nothing like a nice Colt 45 1911 for that purpose. Only in the movies, do bad guys survive that. Although, in a good hand, any caliber will do. Heck, sometime just “racking” a shotgun will do the trick.

Like I recently told a young lady  I know: “No one wants to be down range of a crazy woman with a gun.”

Several people, including children, were inside the shop when the man took out a gun and opened fire. Fortunately, a passer-by pulled out his gun, ran into the shop and shot the gunman before he could kill anyone.

“The person who responded was a legal gun permit carrier,” Philadelphia Police Captain Frank Llewellyn told NBC 10. “He responded and I guess he saved a lot of people in there.”

“I guess” is pretty wishy washy. It would seem obvious that he did save a lot of lives.

William Allabaugh shot a man in the head after being asked to leave the establishment. Mark Kytor stopped Allabaugh by drawing his gun and shooting him. Kytor may have saved many lives because police found an extra clip of ammunition in Allabaugh’s pants, The Citizens Voice reported.

Typically inaccurate reporting. I would assume the shooter had an extra magazine, not a clip. I guess it’s too much to expect the news media to at least be a little familiar with the difference. “This is my rifle. This is my gun. This is for fighting.”

USA – The Journal News in Hamilton, Ohio reports 11-02- 2016 an 88-year-old resident had just finished washing his car in the front yard of his home Tuesday night when a man and a woman cornered him.

They demanded money and forced him into the house.

Once inside the victim said they hit him in the face and in the chest. He thought he was going to be severely beaten. The male robber taunted him “You don’t have a gun, do you?”

A defensive firearm, quickly accessible in the living room, saved this victim’s life. One would not expect any 88 year old to survive a physical beat down. Hopefully there is enough physical evidence available to allow a quick apprehension. The cowardly animals that attack such elderly victims really need to be off the street.

The victim was apparently cool, calm and experienced enough to intend a non-lethal shot. Amazing! The criminal’s comment about the victim indicates that he was perhaps the burglar who stole it previously.

He obviously didn’t feel comfortable taking a life. Many would argue that was a mistake but it’s unfair to second guess victims who were in the situation. It was a choice that is only his to make.

One can never know for sure what we would do in that circumstance.

I’d like to think I could be that cool under pressure.

I’m unaware of any instructor who teaches anything but shoot for the center of mass.

I’d agree that these two leggett varmints need to be put down quickly before they kill someone else. Like a bear that kills a human get euthanized. These two criminals may have learned to kill their victims. 

Sitting here on my couch, as a pro-life little L libertarian, I’d have shot both for the center of mass. If for no other reason than to save their next victim’s life.

So sad to have to say that, but that victim’s life is worth saving.

The other six-in-six Olympian is a woman from Southern California. She should have been asked to carry the flag at the closing ceremonies in Rio. I have nothing but respect for Simone Biles and her five medals in gymnastics, but this sixth medal in six Olympic Games was not only a once-in-a-century achievement, it was also accomplished by a 37-year-old woman who was fighting injuries, who was struggling against decades of sexism in her sport’s Olympic organization, who has to train by herself while raising a 3-year-old son, and who had to learn a whole new sport halfway through her medal run because the Olympics decided only men could compete in her preferred event.

I am NOT  “constitutional scholar”; nor do I play one on TV.

That being said … … …

Unfortunately, the ATF makes the diktats that take guns away. There was a Constitutional Amendment to have alcohol prohibition. BUT NONE was required to have drug prohibition. Why should guns be any different than drugs?

The only defense is for juries to nullify on non-violent drug and gun cases. That’s what ended alcohol prohibition.

So my 9th grade son is taking AP government and his coy teacher says she won’t reveal her political leanings…but then gives it away with her idiotic opinion of the 2nd amendment is being used wrong because it means only people in a militia can have guns. Sigh.

So in providing my son with the basis for an argument to proffer to her as to why that is wrong it suddenly dawned on me how truly absurd that position is. A militia by definition must be armed. An unarmed militia is like an orchestra with no instruments. Why would you create an amendment to protect a right that is implied in the nature of the thing. It would be like guaranteeing all doctors the right to keep and bear scalpels, or fireman the right to keep and bear hoses.

We have to de-federalize the military and get back to state militias and troops under the control of their governors and funded by the individual States.
