Prohibition, Civility, and Political Discourse
Ken Burns
National Press Club | Luncheon Speech

Ken Burns talked about his PBS series, Prohibition, which chronicles the ratification, implementation, and eventual repeal of the 18th Amendment to the U.S. Constitution, as well as the era in which the movement took place. He also responded to questions from the audience.

# – # – #

An outstanding discussion of Prohibition and how it relates to our current state with the “(pseudo) War on (some) Drugs”. While I was aware of the relation between the Women’s Rights Movement, I was unaware of of the relation between the Progressives with the Income Tax and the Dry’s who wanted to eviscerate the reliance of the Federal Government on the booze industry taxes. Worth an hour and you can see that past is prologue.

New federal guidelines are in the works and General Mills, owners of Lucky Charms and other breakfast giants may be forced to drop commercials that attract kids to their products.

It is a $10 billion a year market and the stakes are very high.

“The guidelines would be one of the most important ways for the food industry to improve children’s health,” said Mary Story, a University of Minnesota public health professor and expert on child and adolescent nutrition told the Minneapolis Star Tribune.

What Are Unalienable Rights?

I don’t think I’ve ever seen an expansive article about unalienable rights. We all seem to just refer to the Declaration of Independence and what Jefferson wrote, and then defer to it. But natural law and unalienable rights are where it all starts.

*** and ***

“Unalienable: incapable of being alienated, that is, sold and transferred.” Black’s Law Dictionary, Sixth Edition, page 1523. One cannot sell, transfer or surrender unalienable rights.

*** and ***

Inalienable rights can be transferred, sold or surrendered if you give your consent. Inalienable rights are not bestowed by the Creator or inherent in humans. ”Persons” have inalienable rights, and the word “Person” is a legal term¹. Inalienable rights can be bestowed to persons by government, and can be likewise removed from persons by government. At times, government itself can be considered a “Person” in a legal sense. Most state constitutions recognize only inalienable rights.

POLITICAL: Bank of America lost money

The Market has spoken

About a month ago Bank of America announced it was going to charge a five dollar monthly fee for using a debit card issued by them to make purchases. This led to an uproar. People closed their accounts with BofA and moved their money to credit unions and bank which did not charge this fee. Other people decided not to open accounts with BofA. Bank of America lost money.

Bank of America decided to not charge people for using their credit card. Congress passed no law. No one was sued. No injunctions were issued. No executive orders were given, no bureaucrats regulated. Free people simply applied the pressure of the market place and BofA changed its policy in response to their customers’ needs.

The Market spoke and the government was not involved. Free market capitalism worked perfectly.

And the government wasn’t involved.

Summitt’s diagnosis raises Alzheimer’s awareness

By BETH RUCKER, AP Sports Writer

*** begin quote ***

KNOXVILLE, Tenn. (AP)—Tennessee coach Pat Summitt hopes her public battle with dementia raises awareness about the disease and inspires people to do more.

Kentucky associate head coach Kyra Elzy is one of many whom Summitt has already touched.

After making a New Year’s resolution to do more volunteer work in 2011, when the 59-year-old Summitt made her announcement in August, Elzy saw a perfect opportunity to honor her former coach and her grandmother, who had Alzheimer’s.

Elzy volunteers at Best Friends Day Care in Lexington, Ky., an adult day care for people who require supervision.

“My coach, Coach Summitt, she is very courageous, very strong and a very giving person, so for her to come out in public with the type of platform she brings, everybody takes notice, everybody listens,” Elzy said. “It was so courageous of her to want to help others. She’s a face and a voice that people respect. It’s just breathtaking.”

Summitt, who revealed in August that she’d been diagnosed with early-onset dementia, Alzheimer’s type, isn’t the only famous person fighting dementia and Alzheimer’s.

Many public figures who have faced Alzheimer’s, such as former president Ronald Reagan and actor Charlton Heston, were diagnosed late in life and privately faced the disease.

TINFOILHAT: BHO44 first trip to France as a college student or as a 26 year old?

Obama went to France while in college?
Posted: November 04, 2011 3:14 pm Eastern

*** begin quote ***

On Thursday, while in Cannes for the G-20 Summit, President Barack Obama casually said the following: “The last time I was in the South of France – or the first time, rather – was as a college student, and I’ve never forgotten the extraordinary hospitality of the French people and the extraordinary views that are available here.”

To Obama followers, this comes as news. In his 1995 memoir, “Dreams from My Father,” Obama gives the distinct impression that his first trip to Europe came in 1988 when he was a 26-year-old community organizer.

As told in “Dreams,” Obama spent eight weeks on this 1988 journey, an inexplicable luxury for a chronically broke young man. Europe was allegedly his first stop.

I say “allegedly” because most of the specifics sound like they were pulled from a Michelin Guide. The one exception is a sojourn to the Spanish boondocks that even Obama’s worshipful biographer David Remnick concedes is “not an especially convincing sequence.”

*** end quote ***

A liar can never keep his facts straight.

Watch any cop show on TV. They keep the suspect talking. And, then compare the stories. If the story is different, they study the contradictions. If it’s too identical, they suspect it’s fabricated memorization. Either way, just listen to the suspect. Eventually they will trip themselves up.

Personally, I have no idea what “the truth” is. All I do know is that where there is smoke there’s fire.

Why doesn’t BHO44 release his records?

What would his passport show?

From his own words, he brings this suspicion on himself.

Liar, liar, pants on fire.

This statement cast doubt on BOTH his book and his “travels”.

7 Things I Learned from My 8 Greatest Teachers
Posted by James Altucher on October 16th, 2011

*** begin quote ***

Yesterday was my 25th high school reunion. I wanted to go. I had a car key and I could’ve driven there. I was close to feeling like I was going to do it. But I was feeling somewhat shy. I didn’t like high school much.

When you are rejected so much you build a tough skin. My 8 greatest teachers in life were perhaps the many girls in high school who said “no” to me when I was so desperate to go out with them. Who knows what would’ve happened to me if everything was easy then. Maybe I would not have been able to handle when things became really hard later.

*** and ***

What’s your worst rejection in high school?

*** end quote ***

Rejection?

That’s easy. I grew up in a NYC apartment and had huge crush on the girl who lived on my floor — Gabrielle. I’d time my exits for school to meet her to chat her up in the elevator. Ice in the winter. I’m sure I was even dorkier then. She shunned all my attempts to be polite with no explanation. Many times it was just an icy stare. Like I was <Expletive Deleted> Hannibal Lecher Lecter.

Fast forward to senior year in high school.

I had a car, a series of good paying part time jobs, a drinking problem, and a fairly lively social calendar. Hey, I had money and had no clue how to use it. The worm turned.

She needed a date for her senior prom after a bad break up with a cheating steady; who’d been her steady for all four HS years. Her Mom talked to my Mom. I was scheduled to be busy that night; prior plans. And I stuck to it.

Upon reflection, I was an ass.

I admit now (five decades later) that I could have done it for her. But payback’s a bitch. Looking back, I should have rearranged a mere “attendance at some drinking party” to save that gal’s self-image. She didn’t go to her prom and wasted all the money for it. I never looked back.

That first rejection maimed my self-confidence. And, I turned into the ISTJ I am today.

I found a beautiful young gal who’s arm I twisted to marry me. (She said “no” the first time I asked. Seriously!) And we spent 40 wonderful years before she passed. She made me a much better person than I was before I met her.

So now, I’m left with those shouldas, couldas, and wouldas! Those will kill you.

Maybe I should have taken her to the prom. I might have gotten lucky.

But then, I might have missed my soul mate.

Who can figure the “right” choices?

But I’ve never thought of those gals until now — Friday night Jane, Saturday night Virginia, Sunday Mass with Kissing Mary’s sister, and Sunday night with old what’s her name. All lost in the vestiges of time. They were nice girls to put up with my antics.

They had to know; why did they go?

# – # – #

This reminds me of how my bad conduct almost messed up my relationship with the gal who eventually became Frau Reinke.

In my dogish days, I’d have several dates per week end. All with different girls.

(Yes, has hard as it is to believe, a young fat old white guy injineer at heart could have multiple gal pals. If you were polite, had money to spend, and demanded nothing other than a “wing girl” for these events, you too could lead the life. Reminds me of that “Sexless Innkeeper” episode of HIMYM!)

As a good Catholic boy, I well knew that the key to unplanned pregnancies is where you dipped you pen. No dipping; no ruined lives. (I had four aunts — three actual and one grand — who passed along that concept. And, somehow I missed the Free Love Sixties.)

So anyway, I brought my Saturday night date home and my car died outside her house. Her Dad, a Jasper, who knew I was “responsible” loaned me a spare car. So I could get home. The plan was to get my Gramps to come back on Sunday afternoon and get the bucket of bolts running.

But I had a date for Mass Sunday morning followed by breakfast with another girl.

Hmmm, at the time, I saw no “moral dilemma”.

Went on date. After date, Gramps followed my to Saturday Night’s house, he got the bucket of bolts running. All well and good.

P.S., Sold car on Monday to classmate. Bought new bucket of bolts, after Gramps’ approval, on Tuesday. So as to be ready for weekend whirlwind. Friday Red Garter with the eventual Frau Reinke, Saturday night with Daughter of Jasper. Sunday Mass with Kissing Mary. Sunday night with some other girl for some bar hopping.

When the eventually to be Frau Reinke asked about the car swap, I sort of retold the story. Now Our Girl had an exceptionally well defined “barbara streisand” — aka <synonym for male bovine excrement> — detector. Guess as a result of her bad break up. She pulled me outside the Red Garter and made me focus. (Amazing that late in the evening, I could focus.) She wanted the truth.

(This was before Jack Nicholson’s “You can’t handle the truth” soliloquy.)

Any way, she pointed out that if we were going to get serious — We are? I thought so. But I was playing it very kool — she wanted the truth. And, we could be steadies if I dumped all the other girls and stopped lying. — Who lied? I carefully told the literal truth and omitted any inconvenient “truths”. — Or, she was leaving to go home now. No, I couldn’t drive her home. And, no, I shouldn’t call any more. I was instantly sort of sober. So I caved and said “Steadies? That’s so Fifities High Schoolish!” She said: “Take it or leave it.”

I took it.

Next morning, I called all the other young ladies and cleared my calendar.

About 3PM, She called me and said “What time are you picking me up? Steadies go out on Saturday nights too. And, since your such a good Mass attender, you can now take me.” “Yes, toots. 6PM, OK?” “Fine. And, don’t call me toots.”

Funny now. But I almost blew it.

And, from time to time, I did call her “toots” just to annoy her.

Sigh!

MONEY: 1600% loss

Counterfeiters In Our Midst
by Bill Sardi

*** begin quote ***

Stop debasing our money. This is a trick that has been played upon the masses for centuries now. Mining interests in Arizona, however, want to push on the American populace a flimsy copper-zinc-manganese-nickel Susan B Anthony dollar-coin, actually only worth a few pennies, and Congress is listening if for no other reason than political donations. You can read the USA Today story here.

The false argument is that coins last virtually forever while paper money lasts on average 42 months and the cost savings are estimated at $5.6 billion over 30 years. This would trim $186 million a year off the annual Federal debt of $1.5 trillion (or 1/100th of 1% of the national debt). Here is real cost cutting at work my friend! The Joint Committee on Deficit Reduction will hear arguments for greater use of this pseudo-coin in an effort to reduce the national debt.

*** and ***

Well it is kind of difficult to confront someone with the obvious. Just how much has the US dollar been debased? Let’s try 1600%. That is the current value of a US minted 1-ounce silver eagle gold coin ($1600).

You: You mean to tell me that the paper dollar in my wallet should be able to buy $1600 worth of goods or services?

Me: Yes, that is right. What did you think this means? It means you’ve been fleeced by that amount.

*** end quote ***

So I 1971 US dollar, the kind before Nixon abandoned the international gold standard, would be worth $1600 in purchasing power today.

That’s stunning!

What would it be if we went back to when FDR took us off the national gold standard, remember he paid the citizens 23$/oz and then declared it was worth 32$/oz.

I think it’s about about the same order of magnitude.

Stunning.

Tea Party to Mayor: Make ‘Occupy Richmond’ Pay Up
October 27, 2011 2:37 PM

*** begin quote ***

RICHMOND, Va. (CBS Washington) – The Richmond Tea Party is accusing Mayor Dwight Jones of taking a soft stance against the “Occupy Richmond” protesters and is demanding that the group pay up.

After nearly three weeks of protests and overnight stays in Kanawha Plaza, the Richmond Tea Party is about to send Jones a bill for about $8,000 on the basis that “Occupy Richmond” has been using the area illegally and for free.

Richmond Tea Party spokeswoman Colleen Owens told CBS Washington that the protesters have been given special treatment and free reign of the park and have not had to comply with the strict liability and security provisions that the city required of a Tea Party Tax Day in 2009.

As the person in charge of the 2009 event, Owens said Richmond officials dictated the number of police and emergency personnel they were required to have on site and required a $1 million liability policy to protect the city. Owens said that when a Tea Party member decided to call the mayor’s office to see if the protesters had required any of the necessary permits for the park, the city said that “Occupy Richmond” didn’t have any requirements for them to protest and stay overnight in Kanawha Plaza.

*** and ***

Calls and emails made by CBS Washington to “Occupy Richmond” officials and Jones’ office seeking comment were not immediately returned.

South Carolina sheriff encourages women to obtain concealed weapons permits, carry guns
By Associated Press, Published: November 1

SPARTANBURG, S.C. — A South Carolina sheriff is urging women to get concealed weapons permits and carry guns to protect themselves.

# – # – #

“Victim disarmament is the view that it is somehow better to see a woman raped in an alley and strangled with her own pantyhose, than see her with a gun in her hand.” — T.D. Melrose

# – # – #

“So if a Bravo Golf was to try and rape your sister, you’d kill to stop him; right?” “Yes, Miss Marie.” “If someone was going to kill any of your Classmates, what then?” “I’d do what needs doing.” “Yes, we women do. Did you know John’s paternal grandmother traveled the Oregon Trail, bore 13 children, and fought Indians and Outlaws? She’s in her 90’s now. I’ve read her letters. Women can kill when it’s needed. We may not be as physically strong as men, but who seems to get to change all the diapers?” — character “Marie” answering a question in CHURCH 10●19●62 Volume 1 Page 262

# – # – #

Now, I’m not sure that a 45 is a good choice for old women. Although my Great Aunt slept with one under her pillow for most of her adult life. In her old age, she rubber-banded the grip safety because her arthritis made it hard to squeeze the grip, but not to pull the trigger. On the range with it, she was all over the target. But who in their right mind would want to be down range from a scared crazy lady with a “fire hose spewing lead”. The Range Officer’s instruction to her was “Now, Dear, you just keep pulling the trigger until it locks open. The bad guy might have to reload it or beat you to death with it, but ammo is cheap compared to your life. Personally, I doubt you’ll have any trouble.” And, I heard him say it and I agree with him. Only a nut would mess with her. It was funny to see her do a Cooper stance resting on her cane. Would certainly scare the <synonym for excrement> out of me.

While I defer to the Sheriff’s sound advice, I’d recommend a 380 aka pocket rocket as easier to handle and just as scary.

Of course, if one is going for scary, nothing is as distinctive as the ratchet sound of loading a shotgun. Assuming the elder lady has the arm strength, that’s even more “impressive”. No aim needed and it usually stops at walls to prevent accidents.

“An armed society is a polite society. Manners are good when one may have to back up his acts with his life.” — Robert A. Heinlein

Very polite and very very safe.

I have George and Martha to keep me company; a matched identical pair of Colt M1911 45s. A great “show stopper”.

MONEY: Pinch? Everyone should be scared!

Could You Raise $2,000 in a Pinch?
For Immediate Release
October 28, 2011

*** begin quote ***

Or would you feel pinched?

If your roof sprung a leak or your dentist said you needed a crown, would you be able to write a check to cover such an emergency?

Either might cost $2,000, but about half of Americans say they couldn’t come up with that much cash within 30 days.

*** and ***

If half of Americans can’t come up with two grand in an emergency, imagine their reaction to our advice that you maintain as much as two years’ worth of spending in cash reserves. For most Americans, $2,000 wouldn’t even cover costs for much more than a month.

*** end quote ***

I think that number is conservative.

For one income families, or families where the principle earner, where that earner is over 50, then two years is NOT imho enough.

Last time I updated my formula for estimating “time to find another job”, I had 50-54 as a 3 multiplier / 55-60 as a 4 / 60-65 as 5. That’s probably LOW!!!

A five multiplier says in effect that you may not work again. That is it predicts 5 years to find another job.

Based on what I’m hearing and seeing, 55 and up may be unemployable as other than the WalMart greeter.

These politicians have really mucked up this economy.

And, anyone over 40 should be scared for their “white collar” job. They should be seeking there own business and alternative streams of income.

Those one income families should be thinking along the same lines. Two earners and living on the lesser of the two paychecks is ideal.

No doubt that worse times are coming. Regardless of which party wins in 2012.

POLITICAL: Cut the nonsense about “independent” agency or regulator

Random Thoughts on Obama’s New Mortgage Plan
Posted by Mark A. Calabria

*** begin quote ***

In case you missed it, President Obama gave a big speech out in Las Vegas about both his “jobs” plan and a new plan to help underwater borrowers re-finance their mortgage. First, let’s recognize that it is not really “his” plan. The proposal is being issued by the Federal Housing Finance Agency (FHFA), an independent regulator that the President is supposed to have no control over. Frankly, I find it troubling for a president to be so involved with an independent agency. If a president was out giving speeches when the Federal Reserve changed interest rates, we would all call that bizarre. It is no different here. As someone involved in drafting the law that created FHFA, I can say Congress considered, and rejected, the option of having this agency accountable to the president.

Regulators that don’t really regulate. “Independents” that aren’t.

She “hired” the ‘phews to fill the bags and, when they outgrew the easy money, she sit and carefully do it. I was “fired” from helping because I was not meticulous enough in carefully placing one of each type of candy in each bag.

She had a special bowl for the neighbor’s children that had dollar bills in the bags.

On All Saint’s Day, the day after, the ‘phews would be sure to come over and un-mine the bags. She’d give them the “leftover” dollars for the help. (Easy money, for sure!)

To avoid a very painful evening, I’m absconding overnight to AC for dinner and the comedy club. While it will remind me of her and what we did in AC, even that last glorious trip last January when she was like old, it’s not as hard as seeing all the children.

Back tomorrow.

That’s All Saints’ Day and I’ll go pray for my personal “saint”; Tuesday is All Souls’ Day, and I’ll go again to pray for my personal “soul”.

Sadly!

Who cares? “Might makes right!” I acquire my “rights” by being able and willing to fight for them.

The only reason, that a society “grants” me my rights, is that it can’t afford the price that I will extract if it doesn’t.

If I’m willing to die on a particular “hill”, cause there are always more of them than me, then I put a stake in the ground.

We have examples in history of one person standing up to the mob.

The American Revolution legal? It’s like “jumbo shrimp”. Makes no sense.

Ten things I know for sure:

1. Change is never good; it’s unstoppable, relentless, and often silent.

2. Cherish every moment; even the bad times. You may view them as better than where you are now.

3. Often your paradigms and memes are wrong; you have to keep questioning your assumptions.

4. You should have children so that, hopefully, some one cares.

5. “Run out” all your ideas; hindsight is 20-20. “I could a been a contender!”

6. Figure out your personal “success for your generation”.

7. Advice, no matter how well intentioned, is often wrong. What’s right for the advisor can be completely wrong for you.

8. Time is a unique thing. Everyone has this moment. What you do with it may matter? Carpe diem us an understatement.

9. All of the world’s problems are rooted in “fiat money”.

10. A marketplace is an election in which everyone’s needs are “equally” dissatisfied.

POLITICAL: New drink driving laws in Eire are stealing businesses

New drink driving laws could close half of Ireland’s pubs
Greater public safety means less indulgence

A new drinking and driving law could lead to the closure of up to half the pubs in Ireland.

Irish publicans have reacted with scorn to new drink and driving legislation that reduced the blood alcohol limit to 50mg per 100mls of blood.

The new law has come into force this week, and it’s already being called a deadly blow to the pubs of rural Ireland. In fact, some publicans warn, the new restrictions could lead to the closure of up to half the pubs in the country.

Kerry County Council member and publican Bobby O’Connell told the Irish Examiner that vintners are convinced that up to 50 percent of all Irish pubs will be forced to shut down within the next five years.

“Rural pubs are being decimated,” said O’Connell. “The recession and the off-licence trade have done irreparable damage to the pub trade and now we have this.”

How can the politicians just steal these businesses?

If a society decides to virtually outlaw drinking, then it has the obligation to pay for these businesses.

As a little L libertarian, I think this is all wrong.

I believe that what was originally considered to be bad was fatalities or injuries from accidents as a result of drunk driving. Somehow it’s morphed into driving after having had a beer.

If that was true, my entire generation should be dead.

I think we need a better standard. (1) There has to be a injury or accident. (2) After conviction, there has to be a substantial penalty — financial and jail time — plus restitution. (3) Second offenses, multiple offense, should be impossible due to the jail terms.

Only then will society be protected from irresponsible people.

TECHNOLOGY: Yet Another “Digital Public Library of America”

Saturday, October 29, 2011

http://dp.la/

The DPLA Steering Committee is leading the first concrete steps toward the realization of a large-scale digital public library that will make the cultural and scientific record available to all.

About | Elements of the DPLA | Secretariat | Steering Committee

The DPLA planning initiative grew out of an October 2010 meeting at the Radcliffe Institute for Advanced Study, which brought together over 40 representatives from foundations, research institutions, cultural organizations, government, and libraries to discuss best approaches to building a national digital library. In December 2010, the Berkman Center for Internet & Society, generously supported by the Alfred P. Sloan Foundation, convened leading experts in libraries, technology, law, and education to begin work on this problem; a two-year process of intense grassroots community organization, beginning in October 2011 and hosted at the Berkman Center, will result in a realistic and detailed workplan for launching the DPLA, as well as unveiling of a prototype of the system with specially digitized materials.

The vision of a national digital library has been circulating among librarians, scholars, educators, and private industry representatives since the early 1990s, but it has not yet materialized. Efforts led by a range of organizations, including the Library of Congress, HathiTrust, and the Internet Archive, have successfully built resources that provide books, images, historical records, and audiovisual materials to anyone with Internet access. Many universities, public libraries, and other public-spirited organizations have digitized materials that could be brought together under the frame of the DPLA, but these digital collections often exist in silos. Compounding this problem are disparate technical standards, disorganized and incomplete metadata, and a host of legal issues. No project has yet succeeded in bringing these different viewpoints, experiences, and collections together with leading technical experts and the best of private industry to find solutions to these complex challenges. Users have neither coherent access to these materials nor tools to use them in new and exciting ways, and institutions have no clear blueprint for creating a shared infrastructure to serve the public good. The time is right to launch an ambitious project to realize the great promise of the Internet for the advancement of sharing information and of using technology to enable new knowledge and discoveries in the United States.

What about the Internet Archive, Google’s book capture, and the myriad of other such efforts?

I guess time will sort it all out.

If true, this makes Iran-contra look like a bake sale in comparison. From Ynet:

The Palestinian Maan news agency reported Thursday that the United States has agreed to sell Egypt several F-16 fighter jets in order to facilitate the release of Israeli-American Ilan Grapel. Israel had opposed similar sales in the past.

I wonder if the Israeli pilots will be facing these soon.

Wonder if US pilots will as well?

Argh!
