“The penalty for illegal formation by the defense is a loss of five yards. This rule is not subject to instant replay review. Had the penalty been assessed, it would have resulted in a fourth-and-7 from the San Diego 18 with 0:04 remaining, enabling the Chiefs to attempt a 36-yard field goal,” the NFL said in a statement to NFL.com.

DOD/VA Seamless Transition Program Sputtered to a Halt – source Next.gov

After launching with much fanfare in 2009, the interagency program office charged with developing an integrated electronic health record (EHR) for the Defense and Veterans Affairs departments all but sputtered to a halt in September, Nextgov has learned. The development followed a decision by Defense and VA in February to independently develop their own EHRs, due to the high cost of the joint system, pegged at $28 billion by Frank Kendall, Defense undersecretary for acquisition, technology and logistics. Neither Defense nor VA formally announced the shutdown of the interagency program office. A hint of its demise can be found in an industry briefing that said Christopher Miller had assumed the role of acting director of the office, in addition to his role as program executive officer of the new Defense Healthcare Management Systems Modernization, charged with developing the Defense EHR.

Maureen Schumann, a Pentagon spokeswoman confirmed on November 18 to Nextgov that Barclay Butler, appointed director of the interagency program office in February 2012, left his job in September. Defense and VA are in the early stages of development of a revised charter and organizational chart of the office, Schumann added, and once completed, “the staffing for the IPO will be determined and announced.” While the office has been all but vaporized, both Defense and VA face the rather difficult task of finding a workaround to provisions in the National Defense Authorization Act of 2008 that mandated a joint EHR. The two departments also need to figure out how to work their way around language in the 2014 VA spending bill that also mandates a single EHR, which could become law if Congress passes a 2014 budget.

U.S. Customs and Border Protection can search travelers’ laptops and other electronic devices without a show of reasonable suspicion, according to a federal judge’s dismissal of a 2010 lawsuit on Tuesday.

In its suit, the American Civil Liberties Union had argued that having border officials search the contents of a laptop violated the U.S Constitution unless the officials had a reasonable suspicion that the contents related to a crime. Judge Edward Korman of the U.S. District Court for the Eastern District of New York, in Brooklyn, disagreed and threw out the suit. The ACLU said an appeal is being considered.

“We’re disappointed in today’s decision, which allows the government to conduct intrusive searches of Americans’ laptops and other electronics at the border without any suspicion that those devices contain evidence of wrongdoing,” ACLU attorney Catherine Crump said in a press release from the organization. Crump argued the case in 2011.

* Develop powerful personal networks. (Not just numbers people on Linkedin, Twitter, or Facebook!)

* Invest in themselves.

* Formulate their Plan B, Plan C, D, E, … Z.

* Refine their Unique Value Equations and the corresponding Unique Sales Propositions.

* And, about establish a ruthless financial discipline, that recognizes the expected delay in finding another paycheck, by increasing dramatically increasing “rainy day” savings. (Over 40, one must recognize that you may never find another job like the one you have at the money you are currently making.)

Now that last sentence is very scary. 

You MUST know your BURN rate. You MUST become a MISER (Unless you never need to work again.) You MUST invest wisely and avoid stupid money mistakes.

And, most of all, you MUST have COURAGE!

The “card” companies are too cheap to put in a better level of security on the cards.

They could “chip” them or at least put photos on them.

The industry has many ways to tighten up the controls, but that translates into money.

As long as fraud stays low, they are happy to eat it.

Unless the cost equation changes, not much will happen.

They are the ones who created this mess. 

Without Social Security Number, no of this nonsense would be possible.

Last week’s tragic shooting at Arapahoe High School in Centennial, Colorado, left one student in critical condition.  The perpetrator, a senior at the school, was reported to have randomly shot 17-year-old Claire Davis as she sat innocently in the hallway.  As bad as that was, things could have been much worse.  

Information released this week indicates that the perpetrator was planning a much larger attack and was armed with a shotgun, about 125 rounds of ammunition, three Molotov cocktails and a machete. 

According to a CNN story, Arapahoe County Sheriff Grayson Robinson said of the shooter, “His intent was evil, and his evil intent was to harm multiple individuals.”

On his arm, the perpetrator had written in indelible ink five classroom numbers and a phrase in Latin that translates to “the die has been cast,” according to the sheriff’s office.

But as reported in the Washington Times, the attacker’s mission was stopped short by the quick response of an armed deputy sheriff who was working as a resource officer at the school.  Upon learning of the threat, the deputy ran from the cafeteria to the library, yelling for people to get down and identifying himself as a deputy sheriff.  The horrific incident lasted only a total of 80 seconds and ended with the shooter turning his gun on himself in the library as the deputy was closing in on him.

Tomorrow marks the 40th anniversary of one of our nation’s strongest and most successful environmental laws: the Endangered Species Act. Passed with overwhelming bipartisan support and signed by President Richard Nixon, the Act was the first comprehensive law to address the global extinction crisis.

The Endangered Species Act took a zero-tolerance approach to achieving its goals: no new extinctions, no exceptions. As a result, 99 percent of listed species have been saved from extinction and are on the path to recovery. Some iconic American species, such as the bald eagle, the American alligator, and the Pacific gray whale, have recovered from the brink of extinction and are now thriving in their natural habitats. Beyond the preservation of individual species, the Endangered Species Act helps to keep the interdependent web of live strong.

Today, conservation efforts under the Endangered Species Act are a model for preserving biodiversity around the world. Unfortunately, some in Congress have suggested that weakening provisions of the Act would somehow yield greater benefits for the species it was designed to protect. As a member of the House Natural Resources Committee, which has jurisdiction over the Endangered Species Act, I am committed to protecting our nation’s strongest and most successful environmental law.

Keeping America Safe, On and Off the Battlefield

Congress has taken another step in the ongoing and urgent effort to prevent suicide among members of our armed forces. A new defense bill that passed earlier this month included a provision I wrote to increase suicide prevention and outreach services for key segments of our Guard and Reserve.

These are specific pools of reservists who, when not assigned to active duty units, live and work among us in our communities in their civilian occupations. As such, they lack the ready access to mental health resources available to their active duty counterparts. My provision enables the Adjutant General of any state to request from the Pentagon address data for reservists in his or her state for the purpose of conducting suicide prevention and outreach activities.

The provision is an outgrowth of the Sergeant Coleman S. Bean Individual Ready Reserve Suicide Prevention Act, which I introduced in 2010 following the death by suicide of Sgt. Bean, an East Brunswick reservist about whom I have written previously.

The defense bill also included a provision I wrote to authorize a top-to-bottom review of programs in the Department of Defense to recruit and retain scientists, technology experts, mathematicians, and engineers. This amendment is a direct outgrowth of my work on the National Commission on Research and Development in the U.S. Intelligence Community, which published our final report this summer. It is imperative that American find, train, and retain world-class talent in these fields. The security of our nation quite literally depends on it.

In later years my mother often told us how she and Virginia mixed together the last remaining bread, milk, eggs and sugar with a few raisins and some cinnamon. They put it into the oven with a prayer, and we said our usual prayer of thanks before we ate it. Only the adults knew that those were the last morsels of food left in the house and that none of them had any idea when or how they would be able to get anything else until the next pension check came in on the first. I can only imagine their agony—and their faith.

Christmas morning broke clear and very cold. The snow wasn’t deep, but it stretched unbroken for many miles in every direction. We certainly didn’t anticipate company, but up the road came the county snowplow with a lone blue car behind it. The county never plowed the road by our house, so it was a mystery until the car pulled into our driveway.

Out popped Virginia’s mother! She had shamed the plowman into making a path for her, and he helped her unload boxes of groceries and other things. The children were too busy to notice, however, because we each had a wonderful felt stocking full of nuts, candy and a few small toys. Then, at the very bottom in the toe, was a huge shining orange! Those were worth their weight in gold then and had been very rare in our lives to that point. Don’t harm a human

During reading Jef Raskins “Humane Interface” for the first time I came across him quoting Isaac Asimov’s famous first rule for robots: “A robot shall not harm a human, or, through inaction, allow a human to come to harm.” He rightly pointed to the deep meaning this quote should have to every interface designer and it got me thinking about how right he actually is.

Raskin exchanges “robot” for “computer” and “harm a human” with “lose work” or “waste time”. But I actually would prefer to leave the “harm a human” as is, because it encapsulates both lost work and wasting time, as well as other disastrous events that can occur while using a computer / applications / websites.

Dear Cracker Barrel Customer:

When we made the decision to remove and evaluate certain Duck Dynasty items, we offended many of our loyal customers. Our intent was to avoid offending, but that’s just what we’ve done.

You told us we made a mistake. And, you weren’t shy about it. You wrote, you called and you took to social media to express your thoughts and feelings. You flat out told us we were wrong.

We listened.

Today, we are putting all our Duck Dynasty products back in our stores.

And, we apologize for offending you.

We respect all individuals right to express their beliefs. We certainly did not mean to have anyone think different.

We sincerely hope you will continue to be part of our Cracker Barrel family.

Interesting plot, but the two girls steal the show. AA for the sex that just exudes thru the screen JL for a yeoman’s job at taking a small part and stealing the show. This movie actually made me feel sorry for the politicians. That’s a powerful statement since they are like used car salesmen. Worth the price.

This is a difficult one for me being a little L libertarian.

One presumes that the Zero Aggression Principle is the operative “Golden Rule”.

So hence, I derive the corollary “No victim; no crime”.

And shortly after that: “Justice is restitution”.

If I accidentally injure you, I have to make things right. 

If I intentionally injure you, not only do I have to make it right, but there should be a penalty to ensure I don’t do it again. That’s why I like the concept of “punitive damages”. No better way to get people’s attention than to pile on. (“Now listen McDonalds, juries have been telling you that too many people are being injured by super hot coffee. Will a 16m$ judgment get your attention?” And, it did.)

After a while I came to the realization that the “death penalty” administered by a Gooferment court is too capricious and arbitrary. And, there’s nothing in the Constitution that permits this. So, the Gooferment shouldn’t be killing anyone unless they are preventing force or fraud on a citizen. Beside once they kill you, they can’t fix that mistake.

I can see a possible exception where someone is a convicted felon and they are too dangerous to keep around. Although there’s a lot of land in Alaska for the bad guys to try farming. 

Where my thinking (i.e., memes and paradigms) break down is in cases like this. Intentional, or even unintentionally, killing a fellow human being who has done nothing to you.

How do you make restitution in this case?

And, more importantly, how is the bad guy prevented from doing it again?

“Alaska farming” and if you go outside our “security zone”, then your “restraining collar” blows your head off.

So cases like this really stretch my little L libertarian meme.

The federal government must have made fraud a legal practice. What else could one conclude in light of Obamacare?

When President Obama, his administration and his Democratic cohorts promoted the Affordable Health Care Act, they advertised it with a slew of silver-tongued falsehoods, eloquent misstatements and outright lies. In other words, Obamacare was passed by Congress under clearly fraudulent statements of epic proportions. Almost every promise devised to sell Obamacare to the public and Congress was untrue. Millions of people have lost their coverage, although President Obama stated in 30 to 40 versions that, “If you like your health care plan, you’ll be able to keep your health care plan, period. No one will take it away, no matter what.” There were no caveats, no exceptions, period.

And yet Obama and his staff knew for years that millions of health care plans had to be cancelled because they would be considered substandard by the new law. Lisa Myers at NBC News revealed this shame. She said that the Obama administration had known since the summer of 2010 that millions of Americans could lose their insurance under the law, where “50 to 75 percent of the 14 million consumers who buy their insurance individually can expect to receive a ‘cancellation’ letter . . . . ” As more information keeps coming out, it turns out that Obama’s polished statements had been carefully vetted by his staff, but coldly calculated to deceive the buying public.

Any salesman employing such deceitful business practices would be prosecuted in a New York second. But nobody has brought a class action suit against Obama or his administration for massive and unmitigated fraud. No attorney general from any one of the 50 states has filed charges. The conclusion one would have to reach is that the government has the right to commit fraud.

It would certain appear that “political lies” have reached a new level of audacity.

Clearly, anything that the Gooferment, politicians, or bureaucrats say or publish can not be trusted.

Wonder when the revolution will start?
