Can the government force people who are arrested – but not yet convicted of a crime – to give a DNA sample without a search warrant, or does that violate the Fourth Amendment?  One arrestee is asking the U.S. Supreme Court to consider this important question, and this week EFF urged the court to take the case.

A federal law mandates DNA collection for those who have been arrested for felonies. The FBI analyzes the samples, and puts a profile into CODIS, a national database.  Those who aren’t eventually convicted of a crime can get their information removed if they request to do so, but data from other individuals remains indefinitely.  In this case from the Third Circuit Court of Appeals, U.S. v. Mitchell, the defendant argues that the DNA collection violates his Fourth Amendment right against unreasonable searches and seizures.

Clearly, it”s more than just a tool for “identification”.

As pointed out, it gives your heritage, your health, your health prospects, and who knows what else.

And, “arrested”; not “convicted”.

The “government” claims dominion over you every time it demands an ID from you to buy alcohol! It claims dominion over you every time it demands a card from your doctor to buy marijuana or to get a permit to carry a gun! It claims dominion every time is assumes it has a rightful place in your medical business! It claims dominion every time is supposes it knows how to better prepare you for your retirement. It claims dominion every time it suggests or demands of you whom to kill or whom to die for. And it insults all of us to a point of intolerable degradation when it locks up people who video record its agents (the cop’s) violating the few limitations it still purports to impose upon itself!

The state is controlling your body and what you can and cannot do with it. They have already invoked a weird version of right-wing state socialism, and a total left-wing Nazi police state is quick on its heels. The powers that be are laughing because most Americans haven’t the faintest idea what is actually going on. They seem to know something is wrong, but being philosophically crippled as they are (thanks to the public school system) they haven’t the faintest idea how to determine the cause. In public school you are taught that the “government” is your friend, you are taught that “rights come from “government” that it’s okay to skip the two when you count to ten during the Bill of Rights. You are taught to bow down and lick the hand that “teaches” you, or else detention and a call to your parents will ensue. And if your parents take your side, then they are in trouble! You’re taught that if it wasn’t for “government”, the big-bad-business man will come in and take over everything and children will work for two cents an hour in sweat shops. Or that “terrorists” (ever notice the smallest army is always called a “terrorist?”) will be on every plane and every street corner.

Basically, I contend that contrary to “religion” being responsible for the Crusades, the Inquisition, the St. Bartholomew’s Day Massacre, the treason against the Waldensians, the purges in England, and the oppression in Geneva, to name but a few, it was the fact that these religious positions held a controlling interest in the State that resulted in the terror exacted upon innocents. For instance, Lutheran segregation in post-Luther Germany was a result of the marriage of church and State in that country, the oppression in England of differing religious positions was because of the involvement of the State in religion, Calvin’s oppression was because his religion WAS the State, and, most egregiously, the Vatican itself IS a State, to which over a billion souls worldwide pledge (unwittingly, in most cases) their allegiance, even before their own home countries.

Thus, while religionists have played a significant role in the history of the world, it’s always those people’s access to State power that results in persecution. For instance, you’ll never hear of Baptists, Quakers, or Amish oppressing other religions, as these groups (I am a Baptist) have never sought to control the political reins of any region or State. In fact, Rhode Island’s charter was premised on the Baptistic doctrine of Soul Liberty, a Biblical principle that I would suggest is the foundation for the concepts of Liberty as taught by John Locke and his intellectual descendants.

It’s not a “religious abuse”, but a “Gooferment” abuse!

In the letter, the Church denounced the Obama administration for ordering all Catholic schools, hospitals and social services to provide, in their health insurance coverage for employes, free contraceptives, free sterilizations and free “morning-after” pills.

This affront should tell the Catholic hierarchy, if they did not already know, where they stand in the party of Barack Obama, Hillary Clinton and Kathleen Sebilius. And where they sit – in the back of the bus.

Yet if the bishops will look upon this crisis of conscience, this insult, as an opportunity, they can effect its reversal and recapture a measure of the moral authority they have lately lost.

Not only should the bishops file suit in federal court against the president and Sebelius for violation of the constitutional principle of separation of church and state, they should inform the White House that no bishop will give an invocation at the Democratic Convention.

Then, they should inform the White House that in the last two weeks of the 2012 campaign, priests in every parish will read from the pulpit at Sunday mass a letter denouncing Obama as anti-Catholic for denying the Church its right to live according to its beliefs.

Roe vs. Wade also permits the states to prohibit or to allow abortions during the last three months of pregnancy. Most states prohibit all abortions during the final three months, as this is the period of viability; when the baby can live – assisted, of course – outside the mother’s womb. New Jersey, my home state, is the exception, as it permits abortions up to the moment of birth.

Did you catch that? The Supreme Court declared that the baby in the womb is not a person. When it made that declaration, it rejected dozens of decisions of other courts, in America and in Great Britain, holding that the baby in the womb is a person. This is reminiscent of the Supreme Court’s infamous Dred Scott decision in 1857 in which it ruled that blacks were not persons. In both cases, it cited no precedent, it gave no rational basis, and in Roe vs. Wade, it merely said that because philosophers, physicians and lawyers could not agree on whether babies in wombs are persons, it would declare them not to be persons.

If the baby in the womb is a person, then all abortion is unlawful. That’s because of the constitutional protection for all persons. The Constitution unambiguously prohibits the government from impairing or permitting others to impair the life, liberty and property of persons without due process. Here’s my political beef with so-called pro-life politicians in both parties. In the years in which the pro-life Ronald Reagan and both Presidents Bush were in the White House, from time to time, both chambers of Congress had pro-life majorities. Did you see any legislation passed that declared a baby in the womb to be a person? No. This could have been done by a simple majority vote and presidential signature, and Roe vs. Wade, and all the killing it spawned, would have ended.

So secret that I like Napolitano and how direct he is.

“Right to Life” is enshrined in the Constitution.

Now, I’m not for putting the Gooferment in charge of anything. But, one of its few legitimate duties is to protect rights.

If we say that if life begins at <insert conception, first trimester, viable on their own, birth, or some other point in time>, then we should have a national discussion.

To do less is a disgrace.

The interesting part is that like Dred Scott, the courts are not the proper venue for decisions like this.

Congress has abdicated so many of its powers and responsibility.

If the Gooferment can allow its citizens to be killed at the beginning of life, then how long before it starts killing at the end? Then, the middle. Then, for whatever reason it wants.

What would have happened if Goldman, and JP, and Barclays went under along with the other big banks? Yes, there would have been huge disruption. There would have been a very sharp shot to the economy for sure.  We would have had a “depression.”  And there would have been many destroyed bankers littering the alleyways of New York. They leveraged up, and then they paid the price. Now we can move on.

But we haven’t been able to move on. The Blankfiens and Dimons of the world sent the word out. Capitalism be damned! Print, print, print!

This has kept the same crew that was in power prior to the collapse remaining in power. And even when they mess up again, despite all the free money,  these guys are untouchable. Why in God’s name is Corzine running around looking at new villas in the South of France? There is $1.2 billion of his client’s money that just “disappeared.” He co-mingled the MF Global’s funds with his clients in a last ditch effort to save his posterior and now that money is gone. Where are the leg irons? Oh I’m sorry, anyone who was up for Treasury Secretary is above the law we should know that by now.

But that’s part of Smith’s point. The media has been so well trained to avoid the real issues that the American public just stumbles along in sort of a light drunken haze. It’s more pleasant than reality but the buzz will wear off eventually. The question is if it will wear off before or after everything we once loved about America is gone.

Like the Gooferment, it has been captured by the global elite.

Because, of course, a driver’s license is in fact our national ID card.

It’s impossible to function in modern society without this national ID card – even if you never get behind the wheel of an automobile. You can’t open a bank account, cash a check, visit the doctor, vote, board an airplane or even get a job without one.

Why should keeping an ordinary driver’s license up to date oblige anyone to deal with a government agency, in person or online? I hadn’t even realized that my license was about to expire until an airport security agent pointed it out to me the last time I flew out of Logan. The Registry no longer sends renewal notices; and woe betide the motorist who gets pulled over with an expired license, an infraction that can trigger a fine of up to $1,000, not to mention a potential arrest.

Try to imagine Visa or Discover requiring you to remember when your credit card is about to expire, and making you get in line at a branch office or go online to renew it. On the contrary: They do the remembering and renew your card automatically. Before the old one expires, you get a new one in the mail. And if there is an anomaly in your account, they typically flag it and alert you right away.

In the private economy, automatic renewals are routine. From Netflix subscriptions to homeowner’s insurance to newspaper delivery, vendors and service providers of every description make it simple to keep your account up-to-date. Your antivirus software and 401(k) investments can be put on autopilot, refreshing at regular intervals unless you choose to opt out. Why shouldn’t your driver’s license work the same way?

Maybe the real question is why the state should license drivers in the first place.

I always thought that the Insurance Company should be registering cars and testing drivers. They have the most to lose when the driver screws up or an accident occurs. They seem to be able to manage getting me my insurance ids cards well before they expire.

So why not have a combined vehicle registration and insurace card?

That’s easy. No Gooferment jobs to give to relatives!
