Why did the nominee tiptoe around an easy question?

Perhaps to avoid a discussion of the “trans” issue?

Dumb.

Hit it head on. “There is a difficult issue but courts don’t make public policy. We interpret laws based on specific facts of a case.”

Or at least we should.
