NJ law protects workers who are in the country illegally, court rules

*** begin quote ***

  • Top court rules all workers must be paid regardless of immigration status
  • Employer who hired immigrant worker now on the hook for years of unpaid labor
  • Decision impacts all businesses using off-the-books employees.

The highest court in New Jersey has ruled that all employees must be paid for their work, including unauthorized immigrants hired illegally.

Under federal law, employers cannot hire unauthorized migrants. Civil penalties for businesses that break this law range from $250 to $10,000 per person hired illegally. Employers who engage in a pattern of hiring unauthorized migrants can face up to six months in prison.

In New Jersey, state law requires employers to pay their workers overtime and at least minimum wage. Put simply, a person must be paid for their work. The state Department of Labor says it enforces the law “without regard to immigration status.”

However, Chief Justice Rabner said the lower court ignored the employer’s responsibility to keep accurate records.

Whatever happened to the famous “clean hands” criteria made famous from Judge Judy?

Remember the sources of my education: I’m just a fat old white guy low index Jasper injineer with “degrees” in: Law from watching Judge Judy, Medicine from watching Doctor Phil, Building from watching “Holmes on Homes”, Investing from watching Bernie Made-off, and sensitively Managing Human Resources from watching Chef Ramsey.

What the Chief Justice ignores is that while “employers cannot hire unauthorized migrants” Lopez AND Ruane BOTH knew he was an unauthorized immigrant.

Therefore, IMHO, neither had “clean hands” and the matter should have been immediately dismissed.  The Chief Justice should have: remanded both Lopez and Ruane to jail, notified ICE about Lopez and Ruane to the Federal Deputy Attorney General for New Jersey.

Also, Congress, and Pepuls Republik of Nu Jerzee politicians and bureaucrats should ALL get a collective kick in the ass for “birthright citizenship” and an insane non-recognition of peaceful law abiding “illegal immigrants”.

If I was “king”, I’d solve this in a heartbeat.

  • Change the rules about federal funds for States who don’t abide by or hinder Federal law (i.e., don’t take federal funds if you don’t want to follow federal law).
  • End “birthright citizenship” PERIOD!
  • ALL peaceful “illegal immigrants” get a green card which is IMMEDIATELY revoked upon a felony convictions.
  • Naturalized citizens are “denaturalized” IMMEDIATELY  if they committed fraud or a felony.
  • Illegal immigrants, who came is as children, get a green card and must abide here in peace without committing fraud or felonies.  (We don’t punish people for what their parents do!)

Simple, easy to understand, fair to the

Argh!

NEWJERSEY: Toms River school district faces bankruptcy amid funding cuts

Facing bankruptcy, Toms River schools defy New Jersey education officials

  • Toms River refuses to pass budget amid $175 million in state cuts
  • School officials won’t follow orders to stop programs
  • Taxes would need to go up by nearly 13%

TOMS RIVER — The largest school district in Ocean County, on the verge of declaring bankruptcy due to funding cuts, is slamming the Murphy administration for demanding that it stop student services.

On Monday, the Toms River school board refused to pass a budget for the upcoming fiscal year.

The district, which serves over 14,600 students, has lost $175 million in recent years due to changes in the state funding formula.

*** and ***

Local lawmakers say the problem is Toms River’s spending, it’s Gov. Murphy’s cuts.

In a statement, a group of Republican lawmakers representing parts of Ocean County condemned changes to New Jersey’s school funding formula.

“Toms River is one of the most efficient and fiscally responsible districts in the state. This is a revenue problem, created entirely by a deeply flawed and politically driven funding formula, implemented with zero transparency and even less accountability,” the group of state lawmakers said.

Ahhh, Gooferment Skrules, the flash point of Taxpayer unrest.

Putting mytin foil hat on, might the “State” currently in the hands of the Democrats be seen as punishing Ocean County for its continued Republican support?  I’m sure that thought NEVER entered the “good” politicians and bureaucrats, who only want the best for the State, its “subjects”, and the Taxpayer aka slaves who pay for “good Gooferment”.  Argh!

Sorry but it all goes to the core of several issues (imho):

  • Should we have Gooferment Skrules with the “Teachers’ Union” controlling State politics?
  • Should “taxes” be collected at the State level or should they only be collected at the lowest local level? (Remember the Golden Rule  —  he or she, who has the gold, makes the rules.)
  • Shouldn’t the Taxpayers’ have a representative body that can veto taxes? (When I has a house in Seaside Heights, I paid taxes but had no voice in objecting to tax hikes or intrusive regulations.)

Yesterday, I proposed my plan to end State funded Gooferment Skrules over 20, 40, or 60 years.  I was getting traction until the “leadership” of the Hands Across New Jersey tax revolt group sold out to the Republican Party establishment.

Maybe some young conservative can pick up that “flag” and advance it over the goal line.

PERTH AMBOY — Police say they’ve connected a pair of New Jersey men to home break-ins across North and Central Jersey.

Mohammad Abdeljawad, 41, of North Bergen, and Elias Abreu, 38, of Jersey City, face burglary charges, the Paramus police said on Saturday.

Court records showed the recent charges were connected to Bergen, Hudson, Morris, Passaic, and Middlesex Counties.

*** and ***

In 2012, Abreu was charged with burglary and was ultimately sentenced on a third-degree theft charge, according to state records.

Then in April 2020, he was arrested along with five other people — police accused the group of conspiring to steal packages from a Hoboken building and sell them.*** end quote ***

And what are their immigration statuses?

Why are they not in prison?

If they are “citizens”, were they born here?  If so, shame on us.  If not, their “citizenship” should be revoked and deported.  If they come back, emprison them then deport them.

We have to get tought on career criminals!

NEWJERSEY: Central Planners know best in “affordable housing construction” — not the Free Market!

Fury in NJ as state forces affordable housing construction
Rick Rickman Published: December 28, 2024

*** begin quote ***

In a bold and controversial move, New Jersey is forcing its municipalities to build thousands of new affordable housing units — and local leaders are pushing back.

The state’s latest mandate has some municipalities reeling, with mayors warning that the plan is asking too much and threatens to completely change the character of their communities.

Earlier in 2024, the state Department of Community Affairs released its first official list of affordable housing requirements for every municipality. This follows the passage of a new law that forces municipalities to comply with a constitutional obligation dating back decades.

*** end quote ***

Aahhha, yes, the Pepuls Republik of Nu Jerzee kommissars have issued new diktats and you slaves will obey.

Sorry, but this sounds like it should be coming from North Korea or China; not the USA.

The fourth branch of Gooferment is the bureaucrats in the regulatory state.  Hence, the other branches can avoid blame by pointing at the out of control “regulators”.

Argh!

Sorry but does anyone think that these are “good ideas”.  The invisible hand of the marketplace provides what the people want.  If the politicians and bureaucrats would get out of the way, then we could have “utopia”.

The FED, the FHA – FREDDIE – FANNIE, and countless federal / state regulations make building “affordable housing” impossible.  Who in their right mind would get into the rental housing business?

Argh!

A former police officer and teacher charged in the death of their infant daughter have reached an agreement with Mercer County prosecutors that avoids any time in prison.

Prosecutors said that Daniel Bannister, a police officer in Ewing at the time, hurt his daughter. Catherine Bannister was accused of knowing about the abuse, covering it up, and not getting her daughter help until it was too late.

Judge suppressed evidence from text messages

I hope someone explains WHY the text messages were suppressed.  Seems like very relevant information.

If there is not a great explanation, then the deal should be revoked and the Judge “retired”.

Argh!  Very sad.  How little human life is regarded in our society.
